If you are reading this CONGRATULATIONS !! you have made a life style change and commitment to your personal Fitness, Nutrition and Mindset that will transform your inner self. The journey you are about to embark on will require dedication, discipline and focus, you will have wins and setbacks along the way, as is with life. Utilizing our coaches and community group, staying plugged into the program and following our processes will greatly increase the likelihood of reaching your desired outcome. As grateful as we are for you and endeavour to support you with passion along your journey, we cannot guarantee nor do we guarantee that you will be successful. Applying our philosophies with your own passion and disciple as consistently as possible is key along the journey.

Results vary from individual to individual depending on your goals and your dedication to your Fitness, Nutrition and Mindset.

The policies in this program are guidelines used to provide direction in our decision-making process.

While nothing in life is black and white, only Directors of Elevate FNM can make exceptions to Corporate

Policy, procedure or guidelines. We believe providing consistent direction and process to our community will enable us all to accomplish our Mission, Vision in an ethical and industry respected manner.

1.1 ELEVATE COMMUNITY- What is it ?

The Elevate community is a group of like-minded persons that are sharing a similar journey to yourself, we are very proud of our community strength and we strongly encourage you to plug into the community and share your journey with us. Community is a very powerful and effective support mechanism when the community is like minded and striving for a common purpose. We place a very high value on our community and what it has accomplished along each individual journey, how it has grown, shared, and supported each other, it truly is very powerful and exciting. We understand and respect that without you making a decision to Elevate your life and be part of our community that we would not exist.

Community members often share their wins and challenges on our Facebook group and other social media platforms. Posted content must support the values of Elevate and our community, negative posts or personal attacks of our community members is counter productive and will not be tolerated. Such posts will be removed and your membership in the community will be reviewed.

We are all in this Journey together !!!

The more frequently you utilized the community the more you will reap the benefits and Elevate your personal growth. Daily posts will keep you focused on your journey and allow you to follow your accomplishments and challenges from the beginning.

Elevate Coaches are our dynamic team that provide guidance to the community through The Journey.

We have three coaches for each of our Core Values: Fitness, Nutrition and Mindset. Each coach brings unparalleled dedication to their discipline with the intent of passing down knowledge and supporting you, our community. We have a proven system, that once you commit to, will yield the desired results you seek. Ultimately it is you that will determine your success rate, our Coaches are here to support you along your journey.

Elevate Coaches dedicate much of their time and energy into their own personal growth and continuous learning, this commitment separates our coaches from others in the industry, professionalism that holds us accountable on a daily basis through leadership while living our Core Values.

Personal Accountability

We are accountable for each decision we make in every moment of our lives. We must be personally accountable when no one is there to hold us accountable. This is discipline. Coaches assist you in determining what Core Values you will focus on in your Perfect 4 Months and hold you accountable during your journey. Remember; Coaches exist to assist and support you along the journey, there will undoubtably be some difficult conversations that will assist you in identifying the root cause(s) preventing you from progressing in your journey.

Elite Community members have made a sustainable lifestyle decision to embark on a challenging perfect

4-month journey of Fitness, Nutrition and Mindset Mastery. Elite membership privileges include full access

to:

• Custom nutritional programs

• Mindset Mastery; the perfect 4 months

• Elevate cookbook

• Elevate eBook

• Global challenges

• Weekly calibration and alignment calls

This Elite program is very powerful and life transforming, once completed you are on your journey to becoming the best version of you imaginable.

Elite Membership has extraordinary, life altering Value !!

Elite Members should participate in weekly ZOOM calls to get full program value. We strongly recommend participation to keep you focused on your journey, in addition, the calls provide an individual and community support mechanism that allows you to just be yourself and share your journey with the inclusive Elite Community and coaches.

Elite Community members have earned the ability to represent Elevate and earn income. Your income is generated by funnelling future community members to our website. Any fully paid purchases made from your lead will automatically deposit a percentage of the total purchase into your PayPal account. Your compensation amount will be discussed further in this Terms of Service.

Once you have completed the Elite Program you are eligible for our Ambassadorship. If selected to our Ambassador team you have demonstrated dedication, commitment and alignment with our Mission, Vision and Values. Not all Elites will become Ambassadors of Elevate, there may be some areas that we will require you to focus on to attain the next level. We will have open and honest communications with you and support you towards earning an Ambassadorship.

1.4 AMBASSADOR “You’ve Elevated You”

Ambassadorship is an earned accomplishment that we are very proud to offer to selected community members. Once you have successfully completed the Perfect 4 Months you will be formally assessed using our Ambassador Assessment Process. Assessments are conducted by existing Ambassadors and approved by Elevate FNM Coaches.

There are 3 formal steps to be an Elevate FNM Ambassador.

1. You express interest by contacting us via email. The email heading must read “I am interested in becoming an Ambassador” include a brief description “why I want to be an Ambassador”

2. Elevate Coaches contact you via the email address you provide to us.

3. The Ambassador checklist will be completed by our Coaches to ensure that our values and tangible criteria are in alignment. A review of the checklist will be available at your request. We reserve the sole right to decline a review of the checklist at our discretion without an explanation to you.

As an Ambassador you are a representative of the Elevate FNM Brand. Representing our brand requires discipline and adhering to the Terms of Service. It is imperative that you read, understand and acknowledge the Terms of Service set forth by us.

Ambassadors must be active in our selected social media platforms. Regular posts that align with our Values will assist you in achieving your business goals. We do not guarantee success to anyone, or make false statements regarding our Fitness, Nutrition and Mindset programs, our programs are about you and your commitment to your personal journey. The programs have life altering, proven results !!

1.5 CHALLENGES (Ready, Set, Let’s Go!)

Elevate FNM Challenges bring our community together by pitting You against you and sharing your journey with our community. Challenges are a very powerful forum that will bring out your inner drive and start the process of making you the best version of yourself. Participating in challenges is one of the first steps along your Elevate journey, full commitment and participation in challenges is the only way to achieve your desired results.

All challenges are unique in design and execution, the goal is to find balance in your personal Fitness, Nutrition and Mindset that is sustainable for your lifetime. During the challenges Elevate FNM Coaches conduct weekly calls that provide motivation and direction for the community, they also provide you a forum for sharing wins and struggles.

While challenges are an optional part of our business model, we strongly suggest that you plug in and participate in them, the personal satisfaction of challenging yourself against you is very powerful and unlocks your inner discipline. This is the cornerstone of personal achievement!

Policies

2.0 Business Conduct Policy

We are committed to conducting our business activities in accordance with federal, provincial, state and international laws that apply to our business operations. All accounting and legal practices will comply with federal, state and Provincial reporting guidelines.

Elevate Directors, Coaches and designated representatives must conduct all business relating to our brand in an ethical manner. This simply means doing the right thing and adhering to our Terms of Service agreement under all circumstances.

At no time shall any person representing Elevate FNM make erroneous statements or knowingly provide inaccurate information for the purpose profit or any tangible personal gains. This includes verbal, written or electronic posting on any social media platform. Knowledge of such by Elevate FNM Ltd. will result in cancellation of all agreements between the parties and possible legal action against the person making the known misrepresentation.

Any persons representing Elevate FNM in a public forum must conduct themselves in accordance with our Mission, Vision and Values. Failure to represent our brand in accordance will result in termination of the agreement at the discretion of Elevate FNM Directors.

2.1 Social Media Policy

All social media postings are the responsibility of the persons making the post. The following guidelines must be used when posting on any social media platform in association with Elevate FNM:

• Must have your full name attached to the post.

• Must not contain any sexually explicit, hateful, threatening or be defamatory to a person or group of persons, graphically violent or sexual, target racial or religious groups or any posts that Elevate FNM deem not appropriate or in alignment with our Mission, Vision, Values.

• Must not defame or comment in a negative manner Elevate FNM Ltd or any of our community members.

• Must not “Comment” on other Fitness programs or related programs in a negative or defamatory manner.

• Must not reply to negative comments against you as it relates to your relationship with Elevate FNM.

• Must not solicit business that does not align with Elevate FNM Mission, Vision or Values.

• Must not contain political statements or political views.

• Must be factual and not left to personal interpretation.

• Must have a positive, inspiring tone to promote overall community wellness.

Social Media platforms are powerful tools utilized by Elevate FNM as part of our business model, personal conduct on such platforms must be ethical at all times and provide a positive experience for the reader or viewer of the post. The goal of Elevate FNM among many things is to make our community and those who could be affected by our community the best version of themselves possible. Any posting that contradict this purpose is counter productive and will result in cancellation of our agreement at the sole discretion of Elevate Directors and coaches.

Your submissions, creative ideas, suggestions or proposals whether posted online or sent by email requested or not from Elevate FNM, you agree that we may, without restrictions, use, copy, edit and publish or a combination of each without compensation or recognition to you. We endeavour to monitor but are under no obligation to monitor or comment on any posts on social medial platforms that belong to Elevate FNM.

2.2 Media Inquiries / Podcasts / Go Lives

Elevate FNM utilizes all social media platforms as part of our business model, any postings directed

towards promotions, challenges, products or services must have the consent of Elevate FNM Coaches.

Media Inquires

All media inquiries related to Elevate FNM must be directed to Coaches without a reply from you. To

ensure a consistent message and ensure accurate information is conveyed we insist you refrain from

answering in whole or in part any media inquiries. We may request that you respond in conjunction with

Elevate FNM coaches but prohibit response to inquiries without the consent and direction of Coaches.

Podcast / Go Live

You may be asked to participate in an Elevate FNM podcasts to share your Journey with our community.

All platform goals are to inspire our community to be the best version of themselves, professionalism to

the best of your ability is a must when participating in these forums. Personal appearance, backdrops,

language and attitude must meet the standards of the Elevate FNM Coach conducting the forum.

We reserve the right to post any video generated for Elevate FNM outside of our community (website) to

inspire the collective masses and demonstrate the effectiveness of our programs. This reservation only

applies to members of the Elevate community.

If compensation for podcasts is agreed upon by Elevate and the podcast guest the amount and method

of payment will be agreed upon prior to the podcast airing to the public. Editing of podcasts will be a

collaborative effort of participating parities. Elevate FNM will not make public any podcast where both

parties are not in agreement with the final content of the podcast.

2.3 Code of Ethics

Members of the Elevate FNM community must ensure that they conduct their associated business with

integrity at all times. When interacting with other community members or potential community members

treat others in the same manner that you would expect to be treated. Treating other persons with

respect and conducting yourself with integrity brings out the best version of yourself and aligns with

Elevates FNM Mission, Vision and Values.

The following Ethical guidelines must be practiced when conducting business on behalf of Elevate FNM:

• I will read and understand this policy and ensure that other Elevate FNM community members

are reminded of this policy if this policy is violated.

• I will not, in whole or in any part, copy or duplicate the business model of Elevate FNM for my

own personal gain.

• I will provide the best possible service to all community members using the business model

provided by Elevate FNM. Deviation without consent is a violation of this policy and will result in

termination of the agreement at the sole discretion of Elevate FNM.

• I will report to Elevate Coaches, community members that violate this policy causing damage to

personal reputation or the reputation of the Elevate FNM brand.

• I will maintain the highest level of professionalism when conducting business on behalf of Elevate

FNM. This includes supporting community members by providing leadership, guidance and

integrity.

• I will not disclose confidential information of other community members or Elevate FNM business

model, business forecasts, marketing strategies or any other information considered by Elevate

FNM to be confidential. To disclose such information is a violation of this policy and our Values.

• I will not criticize Elevate FNM or community members at any time. Disputes among community

members or Elevate FNM and community members must be resolved through effective and

constructive communication. Coaches are always available to mediate disputes for satisfactory

resolution, criticism and arguments prevent our community members from being the best version

of themselves.

2.4 Disclosure of Medical Information

It is your sole responsibility to ensure that you are medically clear / fit to participate in any fitness or

nutrition programs offered by Elevate FNM. Although programs vary in intensity, even entry level fitness

programs can cause, initiate or reaggravate an existing or unknown medical condition. We insist that if

you are in doubt or as a general precautionary measure that you consult with a physician prior to

engaging in any fitness program.

Elevate FNM Intuitive Eating consists of varying ingredients, prior to starting any diet check with your

physician to ensure no allergies exist. Elevate FNM in good faith of nutrition, is not responsible for any

persons who may have adverse effects from our nutritional programs. It is your responsibility to ensure

your own health and safety at all times.

If medical conditions exist, Elevate FNM ask that you disclose this information to your coach so we can

develop your plan according to your condition. It is your responsibility to consult with your physician after

our Fitness or Nutrition coach develops a plan based on an existing condition. Verification of our plan with

your physician will ensure that you are on the path to becoming the best version of yourself.

2.5 Age Requirement

Without the written consent and direct supervision of a legal guardian persons under the age of 18 years

cannot participate in our fitness program. Nutrition and Mindset programs add value to any persons at

any age and are exempt from age restrictions. Fasting protocols for persons under 18 must have medical

clearance from a physician and the clearance must be provided to our coaches in writing.

Persons under the age of 18 must have parental consent or the consent of a guardian prior to finalizing

the contractual obligation in this service agreement. The offer and acceptance of this agreement is

finalized by acknowledgment of this agreement and acceptance of full payment or payment schedules.

Monies for persons under 18 will not be accepted by us without consent expressed in this agreement.

2.6 Privacy Policy

Elevate FNM will collect private and personal information as part of our business operations. All financial

information is stored in an encrypted website (Teach:able) and is not available for us or the users of our

website to view at any time. We have chosen a reputable median to ensure, to the best of our ability, the

protection of your financial information and personal information.

There are two types of information that will be collected and stored by Elevate FNM as part of business

activities: Personal information and financial information.

Personal information: Includes photos posted on our group page, website and other social media

platforms, and none photographic posts shared on our group page, website or video posted on our group

page, your name, address, email address, phone number. We will ask for permission to post your photos

outside of our group page and will not post photos of you outside of our group page without your

consent. Consent will be considered granted when you read and acknowledge this agreement. Photos

shared on our group page can only be viewed by our community and is implied consent because the post

is made by you at our request or may be in some circumstance not at our request and voluntary. We will

not volunteer or provide your personal information to any government or law enforcement agency

without being served with legal documents for the request and only provide the information requested in

the legal document.

Personal address, email address, phone numbers or any other personal information we require for our

business operations will not be disclosed to any other persons, financial institution, government agency

unless we are served with legal requests from these agencies. Your personal information can be changed

by you at any time on our website without consent from us.

Comments made by you on any of our social media platforms is considered consent and can be viewed

by anyone at anytime without onus to us.

Financial Information: Includes credit card, debit visa, PayPal account information that is inputted

into our secured website by you and cannot be viewed by us in whole. All financial information is

encrypted and secured by our website; financial information will not be shared by us at anytime unless

we are served with legal documents by a government agency. Reporting monies paid by us to you is your

sole responsibility to disclose as part of your tax filings, this information is provided on your affiliate

account and can be accessed by you at any time.

SECTION 3

Program Administration

3.1 Payments for services provided

Acceptable methods of payment are Credit Card, Debit, PayPal, Apple pay, Google Pay. All information

entered into our system is encrypted to provide you with the highest standard of protection. Payment

schedules are available for our Elite program, any payment made on a schedule must be approved by

Elevate FNM coaches. Scheduled payment plans are at the end of this Terms of Service Agreement.

The offer of our services and the acceptance of the offer by you is finalized by paying the agreed amount

listed for the service requested. The offer and acceptance will not proceed as a service delivered until

payment has been received in whole or payment schedules are honored. We reserve the right to

withdraw our offer for service if payment is not received on the agree upon date or not paid in full.

We are not responsible for persons entering unauthorized payment information for our services, it is the

sole responsibility of the person(s) who entered the payment information to have authorization for the

payment information. Payments received for our services that have not been authorized will not be

refunded but can be cancelled prior to our payment cancellation Terms of Service. Notification of

unauthorized use of a payment method must be done via email and acknowledged by us before

cancellation.

3.2 Payment Cancellation

It is your sole responsibility to cancel payments for our services. Our payment and cancellation process

are simple !! no strings attached. What we ask, is that you let us know why, we endeavor to deliver world

class service and support to our community. If our sustainable lifestyle does not work for you drop us an

Programs or services whether individual, bundled or any combination that have been delivered by Elevate

FNM must be paid in full before cancellation is allowed.

Cancellation of monthly service fees must be made 30 days in advance to prevent reoccurring

withdrawals in the next month.

Payments that have been processed cannot be cancelled or refunded.

Payments that do not go through your account due to NSF will be charged an administration fee of 10%.

This is to recover the cost to us. Accounts 31 days in arrears will be cancelled without notice or refund of

monies already paid.

3.3 Cancellation of service

As mentioned, you are free to cease our services at any time provided you comply with our cancellation

notice timeline. We also reserve the right to suspend or end our services with you at any time at our sole

discretion if you’re not in compliance with our terms of service or use our service, program content, post

on social media or represent Elevate FNM in a manner that would or could cause us legal liability, disrupt

or cause damage to our brand or representation of our brand.

3.4 Changes to our Terms of Service

We reserve the right to revise or change the terms of our service agreement at our discretion. Any

changes or revisions to our terms of service will be posted via a “Notification” on our website, it is your

responsibility to read and acknowledge. When our notification obligation has be fulfilled the changed or

revised Terms of Service agreement will be used as the guideline in any decision-making process. If you

need assistance or clarification on revisions or changes please reach out to us on our website.

3.5 Copyright of Elevate FNM Programs and Services

We provide our community with information on our website, go lives and podcasts including but not

limited to internal company business activities, data, future business plans or any other information

developed and communicated by us. Elevate FNM business, website development, program development

is owned and copyrighted by us, nothing in this term of service agreement or communicated in the above

methods or any other communication method can be interpreted by you as being granted intellectual

property rights or copyrights by you. Copyrighting any materials produced by us or using any data for

your personal use, gains, is considered an infringement and will be defended by Elevate FNM by any legal

means we deem necessary to protect our business activities.

3.6 Intellectual Property

All intellectual property generated by Elevate FNM is owned by us, including trademarks, copyrighted

materials, website designs, Fitness, Nutrition and Mindset content in whole or in part. All rights are

reserved by Elevate FNM including photos, videos, graphic design, reposting of podcasts, videos and

program content without the written consent of an authority designated by the company.

3.7 Disclaimer

Engaging in our programs, services or products could result in injury or illness. Injuries may include but

are not limited to:

• Tendon, ligament or muscle damage resulting from normal or elevated exercise regimes.

• Heart attack resulting from resistance or cardio training.

• Any medical condition that could arise from dramatic weight loss.

• Any condition not listed but could result from engaging in a fitness program.

Illness could result from a change to a healthy diet using our Intuitive Nutrition program. Illness may

include but are not limited to:

• An allergic reaction to some or all of the ingredients in our Intuitive Nutrition Cookbook.

• Any unforeseen incident while preparing or cooking a meal from our Intuitive Cookbook.

• Any allergic reaction to person(s) that you prepare and serve from our Intuitive Cookbook.

• Complications that could arise from a change in diet.

It is your sole responsibility to consult with our Coaches and your physician prior to engaging in any

exercise or dietary program. Elevate FNM will not contradict any medical information received from your

physician, we will work with you and your physician to ensure that all medical conditions are followed

explicitly. All medical information is confidential

3.8 Referral Payments

Our business model is structured to provide compensation to our Elite and Ambassador community. For

this section Elites and Ambassadors are referred to as Affiliates. Compensation is paid out when referrals

are converted into a closed sale of our products, services or any combination thereof. As explained in this

document the payment schedule and process are automated and user friendly.

To receive your payment at the end of each month the person you referred must pay in full. If there is a

balance owing (the person you referred is on a payment plan) you will not receive your payment until the

service has been paid in full.

Elevate FNM utilizes Teach:able as part of our business model. Affiliates must utilize the basic training

provided on the Teach:able website or YouTube , this is the most practical and effective way for you to

learn how to set up your affiliate account.

Payments to Affiliates are scheduled for the last day of the month. Affiliates must set up or use an

existing PayPal account and enter the PayPal account details on Teach:able. Teach:able tracks your sales,

payouts received and other related activities related to Elevate FNM.

Reporting monies paid by us is your responsibility, this information is provided on your affiliate account

and can be accessed by you at any time. You are not an employee of Elevate FNM, meaning we do not

pay government agencies any monies on your behalf. It is your sole responsibility for reporting income

3.9 Referral Payment Amounts

To recognize and reward our affiliate community Elevate FNM will compensate you based on the

following payment schedule. Payments are made when a referral results in a closed sale that has been

paid in full. Refer to Section 3.8 to set up your affiliate account and receive payment.

Elite Affiliate Payments:
